General Terms and Conditions Toyulip

1. Definitions

In these general terms and conditions the following terms are used with the meaning assigned to them:

Toyulip: the entrepreneur who sells products via the website toyulip.nl

Consumer: the natural person who is not acting in the exercise of a profession or business

Order: the request for the purchase of products placed by the Consumer with Toyulip

Product: the good offered and/or delivered by Toyulip

Review period: the period of 14 days during which the Consumer is entitled to withdrawal

2. Applicability

2.1 These general terms and conditions apply to all offers from Toyulip and to all agreements concluded between Toyulip and the Consumer.

2.2 Deviations from these general terms and conditions are only valid if expressly agreed in writing between the parties.

3. Offers and prices

3.1 All prices are in euros and include VAT, excluding shipping costs.

3.2 Toyulip reserves the right to change or withdraw offers.

3.3 Unless otherwise stated, all images of products are indicative only and not contractually binding.

4. conclusion of agreement

4.1 Orders can be placed via the toyulip.nl website.

4.2 The agreement is concluded when Toyulip confirms the order by e-mail.

4.3 Orders placed before 5:00 PM on working days will be processed within 1-3 working days.

5. Delivery and shipping

5.1 Delivery time is 3-5 working days after processing, for a total delivery time of 4-8 working days from order.

5.2 Processing time: 1-3 working days. Shipping time: 3-5 working days within the Netherlands, Belgium and the EU.

5.3 Outside the EU, delivery times may be longer due to customs procedures.

5.4 The shipping costs are stated with the order. Free shipping from €75 within the Netherlands and the EU.

5.5 The risk of damage and/or loss of products rests with Toyulip until the products have been transferred to the Consumer.

6. Payment

6.1 Payment must be made in accordance with the payment methods stated at the time of ordering.

6.2 In the event of non-payment, Toyulip is entitled to suspend delivery or terminate the agreement.

7. Right of withdrawal and return

7.1 The Consumer has the right to terminate the agreement within 14 days after receipt of the product, without giving any reason.

7.2 To exercise the right of withdrawal, the Consumer must contact Toyulip customer service within 14 days of receipt.

7.3 The product must be returned unused, undamaged and in the original packaging.

7.4 The return costs are borne by the Consumer, unless the product is defective or incorrectly delivered.

7.5 After receipt and inspection of the returned product, the amount paid will be refunded within 14 days via the original payment method.

7.6 In case of violation of the return conditions (e.g. used or damaged products), Toyulip reserves the right to refuse or reduce the refund.

8. Exchange

8.1 Exchange is possible within 14 days of receipt, provided the product is unused and in its original packaging.

8.2 Exchange costs are borne by the Consumer unless the product is defective or incorrectly delivered.

8.3 In the event of an exchange, the returned product is first received and checked, after which the new product is shipped.

9. Complaints

9.1 Complaints about the performance of the agreement must be submitted in writing to Toyulip within 7 days of discovery.

9.2 Toyulip will respond to a complaint within 14 days of receipt.

9.3 In case of unresolved complaints, the Consumer can turn to the Consumer Disputes Committee.

10. Intellectual Property

10.1 All intellectual property rights to the content of the toyulip.nl website belong to Toyulip.

10.2 It is not permitted to copy, distribute or edit content from the website without prior written permission.

11. Liability

11.1 Toyulip is only liable for damage resulting from intent or gross negligence.

11.2 Toyulip's liability is limited to the price of the product, unless there is intent or gross negligence.

11.3 Toyulip is not liable for indirect damage, such as consequential damage, loss of profit or lost turnover.

12. Force majeure

12.1 In the event of force majeure, Toyulip is entitled to suspend or terminate the execution of the agreement, without obligation to pay compensation.

12.2 Force majeure is defined as: strikes, fire, natural disasters, war, government action, internet problems or other circumstances that cannot be attributed to Toyulip.

13. Governing Law and Disputes

13.1 Dutch law applies to these general terms and conditions and to all agreements between Toyulip and the Consumer.

13.2 Disputes between Toyulip and the Consumer will be submitted to the competent court in the Netherlands, unless the Consumer opts for the Consumer Disputes Committee.

14. Final provisions

14.1 These general terms and conditions apply as they apply at the time of the order.

14.2 Toyulip reserves the right to change these general terms and conditions. The applicable version is always the one on the toyulip.nl website.
